1. Overview

These Terms of Service (“Terms”) govern your access to and use of the AlbumAI application, website, and related services ("Service"). By using AlbumAI, you agree to these Terms. If you do not agree, you must not use the Service.

2. Eligibility

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use AlbumAI.

3. Your Content

You retain full ownership of all content you upload, including photos, images, and metadata ("User Content").

By uploading content, you grant us a limited, non-exclusive, worldwide license to store, process, analyze, and transform your content solely for the purpose of providing AlbumAI’s features (including AI-generated captions, searchable text, and smart indexing).

4. Use Restrictions

You agree not to:

  • Upload, transmit, or share content that is illegal, offensive, harmful, defamatory, or that violates the intellectual property or privacy rights of others.
  • Reverse engineer, decompile, disassemble, modify, or attempt to access the source code of AlbumAI.
  • Use AlbumAI for any unlawful or unauthorized purposes.
  • Use automated tools (including bots, scripts, crawlers, or data scrapers) to access or interact with the Service, except through authorized APIs with prior written consent.
  • Engage in excessive or abnormal usage that exceeds reasonable personal, individual use and places undue burden on AlbumAI’s infrastructure.
  • Upload or process large volumes of content for the primary purpose of:
    • Bulk content generation
    • Dataset creation
    • Content farming
    • Commercial media production
    • Automated services
    • AI model training
    • Third-party resale or redistribution
  • Circumvent or bypass any account limits, quotas, rate limits, or technical restrictions imposed by AlbumAI.
Reasonable Use Policy:
AlbumAI is designed for personal, non-commercial use. We reserve the right to monitor usage and may suspend, throttle, or terminate accounts engaged in abusive, excessive, or prohibited usage, at our sole discretion.

5. AI-Generated Content Disclaimer

AlbumAI utilizes machine learning and artificial intelligence to generate textual content and metadata from your photos. While we strive for accuracy, AI-generated content may contain errors or misinterpretations. You are solely responsible for reviewing and using any AI-generated outputs.

6. Subscriptions & Payments

  • Certain features may be available only through paid subscription plans.
  • Subscription terms, pricing, and renewal policies will be disclosed at the point of purchase.
  • All payments are non-refundable unless otherwise required by law.

7. Fair Use & Commercial Licensing

If you wish to use AlbumAI for commercial, enterprise, or automated business purposes, including but not limited to business workflows, commercial media production, dataset or model creation, third-party services, or platform resale, you must obtain a separate Commercial License or Enterprise Agreement from AlbumAI.

Unauthorized commercial or automated use is strictly prohibited and may result in legal action, suspension of services, and claims for damages. Please contact us at service@albumai.net for commercial licensing inquiries.

8. Termination

We reserve the right to suspend or terminate your access to AlbumAI at any time for violation of these Terms or any misuse of the Service.

9. Limitation of Liability and Disclaimer of Warranties

  • "As-Is" and "As-Available" Warranty Disclaimer: The Service, including all AI-generated outputs, is provided on an “as-is” and “as-available” basis. AlbumAI expressly disclaims all warranties of any kind, whether express or implied.
  • AI Performance Accuracy: AlbumAI does not warrant that AI-generated captions, indexing, or searchable text will be accurate, reliable, or error-free. You acknowledge that AI technology is inherently probabilistic and you assume all risk.
  • Exclusion of Certain Damages: To the maximum extent permitted by law, AlbumAI shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill.
  • Cap on Liability: In no event shall AlbumAI’s total cumulative liability exceed the total amount paid by you to AlbumAI for the Service during the twelve (12) months preceding the event.

10. Modifications

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use of AlbumAI after updates constitutes your acceptance of the revised Terms.

12. Intellectual Property Rights

  • Ownership of the Service: AlbumAI and its licensors retain all right, title, and interest in and to the Service, including the application interface, design, software, algorithms, and source code.
  • License to User Content: You retain full ownership of your User Content. You grant AlbumAI a non-exclusive, royalty-free, worldwide license to host, use, and modify your content solely for operating and improving the Service.
  • Feedback License: If you provide suggestions, you grant AlbumAI an irrevocable, perpetual, royalty-free license to use such feedback for any purpose.
  • Restrictions on Use: You are strictly prohibited from attempting to extract the source code or unauthorized use of AlbumAI’s trademarks.

13. Indemnification

User Responsibility: You agree to indemnify, defend, and hold harmless AlbumAI from any and all claims, liabilities, damages, and expenses arising from your breach of these Terms, your User Content, or your unauthorized commercial use of the Service.
